B. Why It’s Used
Paper II §9 of the TGPSC syllabus explicitly lists “Hyderabad Municipal corporation Act, 1955, Municipality Act, 1965, Urban area (Development) Act, 1975” as named statutes — making this lesson the single most exam-critical piece of Telangana-specific law in the course. The Town Planning Assistant recruited through this very TGPSC notification will work inside one of these statutory frameworks — most likely under the Directorate of Town and Country Planning (DTCP) or HMDA, processing layouts, building permissions, and Master Plan amendments. Knowing which Act establishes which body, which body has which powers, and how the three statutes interact is the operational core of the planner’s daily work. This lesson is deliberately denser in Telangana-specific content than most others.
C. Mechanism in Words
-
The City of Hyderabad Municipal Corporation Act, 1955 was enacted by the former Hyderabad State (then covering parts of present Telangana, Maharashtra, and Karnataka) to establish the Municipal Corporation of Hyderabad (MCH). Post-bifurcation of Andhra Pradesh (1956 States Reorganisation), the Act continued to apply to the Corporation of Hyderabad in Andhra Pradesh, and after 2 June 2014, to the Corporation in Telangana. In 2007, the Greater Hyderabad Municipal Corporation (GHMC) Act merged the erstwhile MCH with 12 surrounding municipalities and 8 gram panchayats to form the GHMC — but the underlying statutory framework remains the Hyderabad Municipal Corporation Act, 1955 (as amended). The Act establishes the Corporation as a body corporate; defines its territorial jurisdiction; provides for the elected Council, the Standing Committees, and the Commissioner; lists the Corporation’s obligatory and discretionary functions (water supply, drainage, SWM, primary health, street lighting, fire services, building regulation, registration of births and deaths, parks); and provides for the Corporation’s revenues (property tax, user charges, licence fees, grants).
-
The Telangana Municipalities Act, 1965 (originally the Andhra Pradesh Municipalities Act, 1965) governs the smaller urban local bodies — Municipal Councils (Nagar Palikas) and Nagar Panchayats — across Telangana. Modeled on the Model Municipal Law and the central government’s municipal law templates, the 1965 Act parallels the 1955 Act but applies to smaller urban areas. It establishes: the constitution of Municipal Councils and Nagar Panchayats by state notification; the elected Council (Chairperson + councillors); the Standing Committees; the Executive Authority (Municipal Commissioner / Executive Officer); the obligatory and discretionary functions of the municipality; the revenue sources (property tax, profession tax, water tax, lighting tax, advertisement tax, market fees); the budgeting and accounting framework; and the state government’s powers of supervision and dissolution. Telangana’s towns of medium size — Warangal, Karimnagar, Khammam, Nizamabad (some now upgraded to Corporations), and dozens of smaller municipalities — operate under this Act.
-
The Telangana Urban Areas (Development) Act, 1975 (originally the Andhra Pradesh Urban Areas (Development) Act, 1975) is the statute that establishes the Development Authorities — the parastatal planning bodies that operate alongside (and often in place of) ULBs. The 1975 Act authorises the State Government, by notification, to declare any urban area or contiguous group of urban areas as a “development area” and constitute a Development Authority for it. The Authority is a body corporate, typically chaired by the Chief Minister or the Minister for Urban Development, with the Vice-Chairman (an IAS officer) as the chief executive. The Authority’s principal functions are: preparation of the Development Plan (Master Plan) for its area; control of development and use of land (planning permission, building permission, change of land use); acquisition, disposal, and development of land; execution of major infrastructure projects; and coordination with ULBs and other agencies. HMDA (Hyderabad Metropolitan Development Authority) is the largest Authority under the 1975 Act — established in 2008 from the earlier HUDA (Hyderabad Urban Development Authority, 1975), it covers the entire Hyderabad Metropolitan Region (HMR), about 7,257 sq km.
-
HMDA’s principal planning instrument is the Hyderabad Metropolitan Development Plan 2031 (HMDP 2031) — a Master Plan covering the entire 7,257 sq km HMR. The HMDP 2031 designates land use (residential, commercial, industrial, institutional, recreational, open space, water body, agriculture, forest, etc.), establishes the road network (ORR, radial corridors), and sets development control regulations (FSI / FAR, setbacks, height, density). For areas outside HMDA’s notified region, DTCP (Directorate of Town and Country Planning, Telangana) is the planning authority — it approves layouts, prepares Master Plans for individual towns, and coordinates with the Municipal Administration and Urban Development (MA&UD) Department. The DTCP also processes objections and suggestions on draft Master Plans, and is the principal office where Town Planning Assistants are likely to serve.
-
The three statutes (1955, 1965, 1975) interact in a layered jurisdictional map. For Greater Hyderabad (GHMC + HMDA region): the GHMC Act (1955) governs the Corporation’s municipal functions; HMDA (under 1975 Act) governs plan-making and major projects; the state MA&UD Department coordinates between the two. For towns outside HMDA: the Municipalities Act 1965 governs the municipal functions; DTCP prepares the town’s Master Plan under the 1975 Act (often applying the Act’s provisions through a development authority notified for that town or directly through DTCP). The three statutes together create the dual-governance tension (Lesson 7.1): ULBs (1955, 1965) with elected representatives and parastatals (1975) with appointed officials, both exercising planning powers within the same geography.
-
Development control in Telangana is exercised through a combination of statutory Acts and executive orders (Government Orders, GOs). The principal instruments include: GO Ms No. 168 (MA, 17 May 1996) — the Andhra Pradesh Building Rules 1996 (replaced by GO 86 in 2006, and substantially revised since); GO Ms No. 86 (MA, 3 March 2006) — the Andhra Pradesh / Telangana Comprehensive Building Rules 2006 (still widely used); GO Ms No. 252 (MA, 2012) — revised building rules incorporating green buildings, rainwater harvesting; GO 111 (1996) — restricting development in the catchments of Osman Sagar and Himayat Sagar lakes (the Hyderabad drinking water reservoirs) — a landmark conservation order; GO Ms No. 371 (MA, 31 December 2018) — notified the TS-bPASS self-certification / single-window framework (the TS-bPASS portal itself was launched in 2020). Together these GOs operationalise the statutory framework of the 1955, 1965, and 1975 Acts.
-
TS-bPASS (Telangana State Building Permission Approval and Self-Certification System), launched in 2020, is the digital single-window system for building permissions across Telangana. Under TS-bPASS, applicants can self-certify for low-risk buildings (residential up to certain limits) and get instant permission; for higher-risk buildings, a streamlined approval process with strict timelines is followed. TS-bPASS operationalises the building permission provisions of all three statutes (1955, 1965, 1975) through a single portal — a major reform initiative of the Telangana government. Planners processing TS-bPASS applications must verify setback compliance, height, FSI, parking provision, rainwater harvesting, structural safety, and other building byelaws.

E. Worked Numericals and Parameter Tables
E1. Jurisdictional reasoning — Hyderabad
A proposed building in Jubilee Hills (within GHMC and within HMDA) needs permission. Which authority? Both — under TS-bPASS, the applicant submits through the portal; GHMC processes the building permission under the 1955 Act and GO 86 rules; HMDA’s land use zoning under the HMDP 2031 sets the allowable use for the plot. The two are coordinated through TS-bPASS.
E2. Jurisdictional reasoning — Warangal
A proposed building in Warangal Municipal Corporation (Warangal became a corporation) — which authority? Warangal MC under the 1965 Act (as adapted for corporations) processes the building permission; the town’s Master Plan (approved by DTCP under the 1975 Act) sets the land use. HMDA has no jurisdiction here.
E3. Jurisdictional reasoning — a rural panchayat adjacent to HMDA
A proposed layout in a panchayat just outside the HMDA boundary but within the broader HMR region — which authority? The panchayat is under the Panchayat Raj Act for building permission; the layout is approved by DTCP under the 1975 Act (if the area is in a notified development area) or by the District Rural Development Agency otherwise. HMDA jurisdiction ends at its boundary.
E4. FSI computation
A plot in Hyderabad is zoned residential with FSI 2.0 per the HMDP 2031. Plot area 300 sq m. Maximum built-up area (FSI) = 300 × 2.0 = 600 sq m. If the plot is 12 m wide on a 9 m wide road, additional setback / height rules apply per GO 86.
F. Design Criteria
| Parameter | Standard / Typical value | Source |
|---|---|---|
| GHMC Act | 1955 (Hyderabad MC Act) | Statute |
| Telangana Municipalities Act | 1965 | Statute |
| Telangana Urban Areas (Development) Act | 1975 | Statute |
| HMDA constituted | 2008 (from HUDA 1975) | Notification under 1975 Act |
| HMDA area | ~7,257 sq km (commonly cited HMR figure) | HMDP 2031 / HMDA materials — confirm on hmda.gov.in if exact area is tested |
| HMDP 2031 horizon | 2031 | HMDA |
| GO 111 | 1996 — Osman Sagar / Himayat Sagar catchment protection | Government Order |
| TS-bPASS launched | 2020 | Government Order |
| Typical residential FSI in Hyderabad | ~2.0 teaching default (varies by zone / corridor / TOD incentives) | HMDP 2031 + GO 86 — never treat 2.0 as universal |
G. Application Zones
- Building permission processing — TS-bPASS, GO 86 compliance, setback/height/FSI.
- Layout approval — DTCP for towns; HMDA for Hyderabad region.
- Master Plan amendment — HMDA for Hyderabad; DTCP for other towns.
- Land use change — application to HMDA / DTCP.
- Catchment / lake protection — GO 111 in Hyderabad region; similar GOs in other cities.
- Town Planning Assistant’s daily work — most likely at DTCP or HMDA.
